The Introduction is amended to expand the list of available Plan forms to include the new Uninsured Motorist Coverage and Underinsured Motorist Coverage Rejection Form.

Sections 5 and 21 are amended to expand the optional coverages to include underinsured motorists coverage for private passenger and commercial risks.

Section 40 is amended to expand the definition of Private Passenger Nonfleet Automobile Insurance Plan premiums to include underinsured motorists coverage premiums.

Section 44 is amended to include underinsured motorists coverage for private passenger risks in the list of voluntary data excluded from the Voluntary All Other Automobile Liability Net Direct Written premiums used for CAIP participation.

Rules 3, 10, 21, 32, 34, 35, 36, and 51 are amended to reference underinsured motorists coverage.

Rules 26 and 57 are amended as follows:

(1) all auto liability policies must be afforded uninsured and underinsured motorists coverage.

(2)prior to issuing a new policy or on the first renewal or replacement of an existing policy, a named insured shall be provided with a standard statement explaining, in summary form, uninsured motorists coverage and underinsured motorists coverage.

(3)The named insured shall have the right to reject either or both coverages, in writing or in an electronic record, and such rejection applies to all other insureds.

(4)Subsequent renewal or replacement policies need not provide the rejected coverage unless requested in writing by the named insured.

(5)Rates for basic and increased limits are included for uninsured and underinsured motorists coverages.

The private passenger, trucks, tractors, and trailers, and public transportation worksheets are amended to include UIM coverage.

These amendments are effective January 1, 2009.
